By law, every parent must pay child support. Indiana requires each parent to contribute to the child’s overall welfare. In most cases, the person with primary custody receives child support payments from the other parent. Child support amounts are based on child support guidelines set by the state, the number of overnights each parent has, medical expenses, and daycare / schooling expenses.

MODIFICATIONS

After the court enters an order or a final judgment for dissolution of marriage, you might need to make changes. The only way to make modifications, even if the other parent agrees, is to ask the court to enter an order with those changes. If the other parent agrees, you’ll need a settlement agreement so the court will enter an order.


If the other parent doesn’t agree, you’ll have to ask the court for a hearing on the matter. If the court agrees, it will enter an order with the changes. You can modify child support and custody orders under certain circumstances, including but not limited to:


  • An unexpected and unforeseen change in financial circumstances.
  • A long-term or permanent illness.
  • You learn the other parent developed physical and emotional abuse issues toward the children.
  • You learn the other parent developed substance abuse issues.
